Of course we value your registration with the Foundation GXP, established in Utrecht and registered in the trade register of the Chamber of Commerce under number 62406264 (hereafter: “GXP”). GXP provides a platform for the promotion of research into human choice behaviour. A few conditions apply to your registration however.
Take into account that continuing your registration means that you agree with these Terms & Conditions. If you do not agree with the Terms & Conditions you cannot be registered.
We also point out that we process your personal data in conformity with our privacy statement.
1. Definitions
- The terms ‘you’, ‘your’ refer to the person using the website;
- The terms ‘we’ and ‘our’ refer to our GXP;
- ‘Panel’ refers to the group of individuals who registered with GXP to participate in (scientific) research;
- ‘Participant’ refers to a member of the Panel;
- ‘Research’ refers to research made available on the website by GXP;
- ‘Website’ refers to the websites managed by GXP on which the research is made available and can be completed by the Participant.
2. Your obligations at registration
To participate in the Panel, you agree with providing truthful, accurate, current and complete information about yourself as requested in the registration form. If you provide information that is untrue, inaccurate, not current or incomplete, or GXP has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, GXP can postpone or terminate your participation in the Panel.
3. Your rights as a Participant
Despite the fact that we hope that you will remain linked to the Panel as a Participant, you may terminate your participation in the Panel at all times. This is possible by sending an email to info@gxpfoundation.org.
Participants of the Panel are invited by e-mail to take part in a Research if they meet the relevant selection criteria. You can then decide whether you want to participate in the research, you are not forced to do so. On the other hand you cannot make claims with GXP on participation in a Research.
4. Your obligations as a Participant
You may only have one active account. If GXP has reasonable grounds to suspect that you have several active accounts, GXP can suspend or terminate your account.
Despite the fact that you are not obliged to take part in the Research, you are expected to participate in the Researches you are invited for with certain regularity. If there is structural refusal to participate in Research, GXP reserves the right to suspend or terminate your participation in the Panel.
To guarantee the quality of the Research, it is important that questions are answered truthfully. GXP reserves the right to terminate your participation in the Panel if you give untrue answers when participating in the Research.
GXP reserves the right to suspend, modify or terminate participation in the Panel if rules, instructions or conditions are abused.
GXP is not liable to you in the circumstances stated above.
5. Intellectual Property
All materials, including and not limited to any text, design, images, drawings, photos, videoclips, music and sounds, trademarks, service marks and trade names on the Website (among others in relation to the Research) and the selection and arrangements thereof (jointly the “Content”) are subject to the intellectual property rights, including author’s rights, trademarks and patents or the right to application for registration thereof, anywhere in the world, held by or licensed to GXP, or other third parties who hold this intellectual property. You are not authorised to use, divulge, download, copy, distribute or reproduce the Content (including posting on websites, social media or blogs). All intellectual property rights are explicitly reserved.
6. Payment policy
You will receive payment for participation in a Research. The extent of payment varies depending on Research; you will be informed about the payment by Research. Payment will only be made if you complete a Research in a satisfactory manner in the opinion of GXP.
GXP is not liable or responsible in any way for the possible fiscal or other consequences or obligations that could result from receiving payment by the Participant.
7. Use of the Website
You accept that the use and browsing of this Website is at your own risk. Neither GXP, its customers or other third parties, nor their managers, officers , employees, representatives, agents or possible licensors shall accept any liability in the matter.
8. Liability of GXP
Under no circumstance will GXP, its customers or other third parties, their managers, officers, employees, representatives, agents or possible licensors be liable in any way, including and without restriction of any matter related to the participation in the Panel, in case of indirect damage, special damage, additional damage, moral damage or trust damage, loss of profit, loss of expected savings or any other not direct or indirect damage caused by GXP, irrespective of whether GXP is aware or has been informed of the possibility of that damage.
In any case the liability of GXP is limited to an amount of 2 500 € maximum per event.
The restrictions of the liability apply irrespective of the nature of the action, either in contract, warranty, unrightful act, strict liability, negligence or other unlawful act.
9. Termination
GXP can terminate your participation in the Panel at all times and can immediately refuse your access to the Website and the Panel, without prior notice, if you do not meet a condition or provision in these Terms & Conditions.
10. Rights to modify and manage the Website
The content of the Website is subject to change, restriction or termination without any notice to you.
11. Rights to modify the Terms & Conditions
We reserve the right to modify, change or update these Terms & Conditions at any desired moment. If we implement changes in the Terms & Conditions we will update this page and post an announcement on the homepage of the Website with a link to the modified Terms & Conditions. If you continue to use the Website after such a message was posted, this means that you accept the new Terms & Conditions.
12. Invalidity
If, for any reason, any provision of these Terms & Conditions is declared null and void by a court of justice, destructible or otherwise not enforceable, this provision is considered separate from the rest of the agreement. The rest of the agreement can then be explained and interpreted without reference to the non enforceable provision.
13. Complaints and disputes
The Dutch law solely applies to these Terms & Conditions and the participation in the Panel. Disputes between GXP and the Participant arising from participation in the Panel will be submitted to the Tribunal of Amsterdam (Netherlands), without prejudice to the right of GXP to have a dispute settled by the competent judge under binding law. If GXP, based on this article, informs you in writing of its intention to have a dispute settled by the Court of Amsterdam (Netherlands), you need to inform GXP in writing within one month that you wish the dispute to be settled by the competent judge under binding law. If you omit to react within one month, the Tribunal of Amsterdam (Netherlands) is competent.
Language of Terms & Conditions
These Terms & Conditions are in any case, but not exclusively, drawn up in the Dutch language. In the event of dispute on the content and sense of these Terms & Conditions, the Dutch text and meaning thereof shall be exclusively binding in the Dutch jurisdiction.
